Terms & Conditions

These terms cover all My Triathlon events [Tatton Park, Tatton Park, Yorkshire, Birmingham, Belvoir]

IMPORTANT. These Terms and Conditions cover the events to be held during 2012. Please read them carefully prior to registering for the event. You should only register and enter the event if you have read, understood and agreed with these conditions. These conditions represent a legally binding agreement between you and My Triathlon Limited.

Who are we?

Limit of Liability

The Organiser shall not be liable for any loss, death, injury or damage however caused to any person or property, except where such loss, death, injury or damage is a result of the negligent acts or omissions of the organiser. Any claim to which legal liability is established shall not include damages for indirect or consequential loss.

Conditions of Entry

The event is run under Triathlon England Rules and Regulations and the entrant agrees that they will compete under these rules. The rules and regulations are available from

British Triathlon Rules

You must comply with the age requirements for entry. The minimum age for the Sprint and Olympic is 15 years at 31 December 2012. If you are 14 years of age on 31 December you may enter the super sprint event.

You acknowledge that participation in a triathlon involves the real risk of serious injury or death from various causes including exertion, strenuous activity, equipment failure, dehydration, collisions, or incidents involving other competitors, spectators or other road users, aspects of the course or bad weather conditions.

The event will be physically demanding and you are aware of the associated medical and physical risks involved. You accept that you are physically capable of competing in the event and agree that, subject to the limitation of liability paragraph below, My Triathlon, its officers, agents, affiliates, sponsors or medical advisers are not responsible for any injury or illness that you may suffer as a result of your participation in the event. The entrant accepts that should any medical or physical condition arise prior to the event which is likely to affect their ability to compete then the entrant will withdraw in accordance with these terms and conditions.

It is the entrant's responsibility to ensure that their equipment including bike is roadworthy and helmet complies with the Triathlon England rules and regulations. The organiser reserves the right to disqualify or remove the entrant from the event for general misconduct, dangerous racing or other unreasonable behaviour. Should the entrant be disqualified or removed there will be no entitlement to a fee refund or a entry credit.

You will inform us on the reverse of your race number of any medical conditions from which you suffer. You give permission to our Event staff and medical support [Red Cross] to make decisions regarding your medical care and treatment and, where necessary, to authorise such care and treatment in emergency situations. You understand that our event staff will make every reasonable effort to reach your emergency medical contact you have supplied, however you herby give permission to the medical professional whose services might be required to provide medical care and treatment.

Unless otherwise specified by the organiser and subject to temperature readings on the day, swimming wetsuits are compulsory for the open water swim section. It is the entrant's responsibility to provide a wetsuit . Entrants without a wetsuit will not be allowed to compete. Shortie wetsuit are allowed but not recommended since they are not as buoyant as a swimming wetsuit. Surfing wetsuits will be very tiring on the swim as they are not as flexible as a swimming wetsuit.

All necessary race information for the event will be published on the event web site. Updated details of any alterations to race information will be made available on the web no later than 7 days prior to the event. It is the responsibility of the entrant to ensure they have accessed the relevant information on–line. No information will be sent through the post. It is your responsibility to ensure you have provided us with a valid e-mail and we recommend storing our e-mail in Outlook to prevent important e-mails going to 'junk'.

You further acknowledge and understand that compulsory insurance effected for the event may not cover you for any or any injury, loss or damage sustained by you. You are strongly advised to obtain personal accident and personal items coverage, adequate for the event.

Withdrawal or Cancellations

All entries are electronic. There is a 10 day cooling off period after placing your order when a full refund is possible if you contact admin@mytriathlon.co.uk within 10 days. You may withdraw from the event at any time, subject to the provisions of this clause. If you withdraw more than 90 days before the event you will receive no refund but we will provide you with a place for a £10 nominal administration fee for the same event which we propose (but do not undertake) to run in 2013.

If you withdraw between 90 days and 14 days you will receive no refund but we will guarantee you entry for the same event in 2013 which we propose (but do not undertake to run in 2013) subject to you completing an entry form and paying the applicable entry fee. [we need to receive this entry 90 days before the 2013 event date.

If you withdraw less than 14 days before the event you will receive no refund and will not be guaranteed a place for a future event.

We reserve the right to change the format of the event to a Duathlon or cancel the event. We will only exercise these rights due to events beyond our control and in the event of the event being cancelled we will issue a refund net of any costs incurred. One example of such a change could be if extreme weather means that the swim could not take place for safety reasons in which case the event would change to a Duathlon (Bike and Run).

Should we require to change the date of the event, you will have 14 days to notify us of your withdrawal from the event and receive a refund but thereafter will be held to the above terms. Should we have to cancel the event we will offer you a place at one of our other events during 2012 or 2013. Entrants who are members of Triathlon England, Welsh Triathlon or Triathlon Scotland will receive a discount when they book. At registration they must provide their valid membership card. No refunds will need to be issued on race day. If your membership card is not shown the additional fee of £3 for a day license must be paid on race day.

The entry to the race is not transferable to another individual.

It is not be possible to change race distance unless a transfer fee of £20 is payable on-line. No transfers can take place after 30 days before the event date.

If you wish to race with someone else there is a code that both must be provided when you enter the event. This information cannot be provided after you have entered. Please note that women only waves are available and if you choose to race with someone of a different sex you accept that we will place you both in a wave of our choosing.

Publicity and Results

You irrevocably consent to your appearance being filmed, recorded on any media of whatever nature, and consent to your name, appearance, photograph being used for the purposes of promoting the event and to the commercial rights relating to the event.

We reserve the right to change these terms and conditions.

General

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.

These conditions constitute the entire agreement and supercede any previous agreement between you and the organiser. You acknowledge by completing the entry form you cannot rely on any statement or representation or assurance however made by any person other than as laid out in this agreement.

If any of these conditions shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these conditions, shall be enforced to the fullest extent allowed by law as to the effect the intentions of the parties, and shall not affect the validity of any remaining conditions.

The terms and conditions do not affect your statutory rights.
